I. General Provisions

1. Introduction/Acceptance of Terms:

   • By visiting, using, or making purchases from Heritage Farm and Dairy LLC store (in-person or online, if applicable), customers agree to terms and conditions as outlined below and on our Heritage Farm and Dairy LLC website.

   • Terms may be updated and that continued use constitutes acceptance of the changes.

 

II. Product Information and Sales

1. Product Descriptions:

   • While we strive for accuracy, product descriptions (including images, pricing, and availability) are subject to change.

   • There will be natural variations in farm products (e.g., size, color, exact weight of produce or meat).

2. Pricing and Payment:

   • Prices are subject to change without notice.

3. Availability:

   • Products are subject to availability and our farm reserves the right to limit quantities or discontinue products.

   • If a pre-ordered item becomes unavailable, we will inform our customers ahead of time via FB and/or Email.

4. Order Acceptance and Cancellation:

   • Order is considered accepted upon payment.

   • Policy on cancellation: 24 hours prior to agreement pickup date. We reserve the right to cancel an order at anytime due to unforeseen circumstances and product unavailability

5. Perishable Goods Disclaimer:

   • All perishable products are sold 'as is' at the time of pickup/purchase.

   • Once items leave our premises, we are not responsible for improper handling or storage by the customer.

   • Customers are responsible for understanding and adhering to proper storage and consumption instructions provided with our products to ensure safety and quality.

III. Pickup

1. Pickup Procedures:

   • Detailed pickup process:

     • Designated pickup times and days can be found on our website.

     • Policy for late pickup: phone call prior to arrange for a late pickup. Items may not be held after closing time of the day of schedule pickup. 

     • All items not picked up could potentially be sold to someone else and may be removed from milk list unless other arrangements have been made. 

 

IV. Returns, Refunds, and Exchanges

1. General Policy:

   • Due to the nature of farm products (especially perishables), returns and refunds are restricted. Please call or email us with any concerns or questions at that time so we can work with you at our discretion.

   • Due to the nature of our perishable products, all sales are final once picked up/delivered. We do not offer returns or exchanges on perishable items unless there is a verifiable quality issue upon pickup.

 

V. Disclaimers and Limitations of Liability

1. General Disclaimer:

   • Heritage Farm & Dairy LLC store provides products "as is" and makes no warranties, express or implied, regarding fitness for a particular purpose or merchantability, beyond what is legally required.

2. Allergen Disclaimer:

   • Our products are produced in a farm environment and may come into contact with common allergens, including but not limited to nuts, dairy, gluten, soy, and eggs. Customers with allergies should exercise caution and contact us for specific ingredient information. We cannot guarantee allergen-free products.

3. Food Safety and Handling:

   • It is the customer's responsibility for proper handling and storage after purchase.

   • While we adhere to strict food safety practices, once products leave our farm, their safety is the responsibility of the customer through proper refrigeration, handling, and cooking.

4. Limitation of Liability:

   • Heritage Farm and Dairy LLC’s liability for any issues arising from the purchase or use of products is limited to the purchase price of the product 

   • Heritage Farm and Dairy LLC is not liable for indirect, incidental, or consequential damages resulting in the use or misuse of products sold.

VI. Privacy Policy

1. Data Collection:

   • Personal information we collect (e.g., name, contact, order details) is used only for internal use for product disbursement.

 

VII. Intellectual Property

1. Farm Store Content:

   • All content on our website, social media, and in-store materials (logos, images, text) is our property and protected by copyright/trademark law.

 

VIII. Farm Visit Specifics

1. Farm Rules/Visitor Policy:

   • For all customer pickups directly on the farm:

     • No trespassing outside designated areas.

     • Supervise children at all times.

     • No pets (or service animals only, with prior notice).

     • Respect farm equipment and animals.

     • Do not pick produce (unless we have a U-Pick day).

     • Adherence to any biosecurity measures.

     • Assumption of risk for farm visits (e.g., Visitors acknowledge that a working farm environment may present inherent risks, and visitors assume all risks associated with their visit to the farm.).
